JAMMU: The Prosecution Department Jammu and Kashmir today announced that ten bail applications were dismissed/rejected by the Hon'ble courts at Districts Jammu and Samba between October 8 and 14, 2026, following well-prepared and vigorous opposition by Ld. Prosecutors appearing for the UT.
On October 14, 2026, four different bail applications of accused persons namely Sourab Baloria, Vivek Kumar, Jugdeep Kour and Manmohit Singh in FIR No. 146/2026 of Police Station Vijaypur, registered under the NDPS Act and Arms Act, were dismissed by the Additional Sessions Judge, Samba Arvind Sharma. The Ld. Addl. Public Prosecutor Kuldeep Bhat argued the matter and strongly opposed that the accused were allegedly functioning as part of an organized network of gangsters involved in narcotic smuggling and the supply of weapons. He further highlighted that links had been established with Canada, the United States and other Western countries raising serious concerns regarding national security and public safety. The Hon'ble Addl. Sessions Court Samba, considering the seriousness of the allegations and the ongoing investigation to unearth the wider syndicate, dismissed the bail applications.
On October 13, 2026, Ld. Addl. Public Prosecutor Sarfraz Ahmed appeared for the UT before the 1st Additional Sessions Judge, Jammu Amarjeet Singh Langeh, in four anticipatory bail applications relating to Police Stations Bahu Fort, Miran Sahib and Bakshi Nagar. Three applications were dismissed as not maintainable, being not in conformity with High Court Notification No. 1399 of 2026/RG dated 02.07.2026. In the fourth, the bail application is dismissed as withdrawn, as petitioners withdrew the application with liberty to file afresh.
On 12.10.2026, the 2nd Addl. Munsiff Jammu, Isha Jerath, rejected the bail application of accused Bhader Ali in FIR NO. 172/2026 of Police Station Janipur, under Sections 331(3), 305, 317(5) and 61(2) BNS. The Ld. Asst. Public Prosecutor Neha Sharma strongly resisted the bail plea and raised the applicant's non-disclosure of criminal antecedents by affidavit, relying on Rule 176-A of the J&K High Court Rules, 1999 and the Supreme Court's Zeba Khan ruling. She also said that accused Bhader Ali is involved in 08 FIRS and recovery of gold ornaments and cash is still pending.
On October 8, 2026, Chief Judicial Magistrate Samba Smriti Sharma rejected the bail application of the accused in FIR no. 85/2024, under section 331(3) and 305(a) BNS. The Asst. Public Prosecutor Megha Rani strongly argued that the accused's criminal antecedents, including ten other pending FIRS, reflect his repeated involvement in criminal activities. She further submitted that his alleged involvement in similar offences despite being released on bail in previous cases demonstrates disregard for the process of law and raises a reasonable apprehension that he may repeat such offences and fail to abide by bail conditions. The Hon'ble Court, after considering the prosecution's objections and the accused's criminal antecedents, dismissed the bail application, observing that the cumulative circumstances weighed against granting bail.
Across all ten orders, the Department recognizes the Ld. Prosecutor's thorough case preparation and command over statutes and Supreme Court precedent. These outcomes reflect the Department's commitment to professionalism, accountability and the rule of law.
