In loving memory of Dr. Priya Ranjan: A mentor who treated me like family

SRINAGAR:: The All Jammu and Kashmir Panchayat Conference (AJKPC) expresses deep concern over a recent government order titled "Conveying of Capex Ceilings including District Capex under BE 2025-26 for finalization and uploading of approved works/activities on the BEAMS portal," with the deadline fixed for  30 April 2025.

It is both shocking and unlawful that the task of finalizing the Capex Plan has been entrusted solely to District Development Council (DDC) members and MLAs. This action is in direct violation of the Jammu and Kashmir Panchayati Raj Act, 1989 and the Panchayati Raj Rules, 1996, which guarantee democratic, grassroots-level participation in planning processes.

As per the law, in the absence of elected Panchayats, Sarpanches, and Block Development Councils, the responsibility for the preparation and approval of the Capex Budget Plan lies with the Gram Sabha—comprising all registered voters of the Panchayat. The Block Development Officer (BDO) is legally bound to convene these meetings to facilitate inclusive and transparent planning.

By bypassing the Gram Sabhas and neglecting statutory procedures, this order undermines democratic governance and deprives the rural population of their constitutional right to participate in local development decision-making.

Anil demands the immediate withdrawal of this unconstitutional order and calls for the urgent scheduling of Gram Sabha meetings in all Panchayats across Jammu and Kashmir. Finalization of the Capex Plan must strictly follow the provisions laid down in the Panchayati Raj Act and Rules.

Sharma appeal to all Sarpanches, former BDC Chairpersons, DDC Members, and DDC Chairpersons across the 20 districts to unite in defense of rural democratic rights and uphold the rule of law. AJKPC  President remains steadfast in its commitment to grassroots democracy, transparency, and participatory governance.
