JAMMU: Prime Minister Shri Narendra Modi made a historic visit to J&K (Ladakh, Kashmir & Jammu) on May 19, 2018 deserves to be recorded in the Guinness Book of Record but the countrymen must answer a big question raised by angry Kashmiri leaders including Ali Shah Geelani and Mirwais Umar Farooq on raising a 70 years old question on the constitutional relationship of J&K with the rest of the country (India). Veteran angry leader Syed Ali Shah Geelani’s statement deserves to be answered by the Indian leadership including Prime Minister Modi when he asked this (J&K), “It is an issue concerning the basic and fundamental rights of more than 14 million humans (Indian citizens). Beating the drum of ‘development’ as the only remedy for all issues look not only unrealistic.”
Prof.Bhim Singh, Chief Patron of National Panthers Party & Sr. Advocate in Supreme Court of India who has been a legislator in the Assembly and the Council of J&K. Syed Ali Shah Geelani was an elected MLA in 1977 when Prof.Bhim Singh was also elected MLA. They spent five years together on the same bench of the Assembly. Both of them had taken oath of Constitution of J&K as well as Constitution of India swearing loyalty. Prof.Bhim Singh resigned from the Assembly one year in advance when Assembly’s life was extended to six years by the Assembly under the leadership of Sheikh Mohd. Abdullah. NPP Supremo resigned from the Assembly founded Panthers Party and re-entered Assembly as Panthers Party Legislator whereas Ali Shah Geelani lost the second election to the Assembly. Prof.Bhim Singh while reacting on the above quoted statement of Syed Ali Shah Geelani urged the Parliament of India to answer the important questions raised by Syed Ali Shah Geelani and tell the nation;
1. Why Articles 370 and 35(A) were inserted in the Constitution of India?
2. Why the Chapter in the Indian Constitution on the Fundamental Rights was surrendered to the Assembly of the State by introducing ‘A’ at the bottom of Article 35?
3. Why the residents (citizens of India) have been deprived to the residents of J&K?
4. Taking away all Fundamental Rights from the Permanent Residents of the State (citizens of India) by inserting 35(A) by a Presidential Order (1954) was unrealistic, unconstitutional and discriminatory against the residents of J&K?
5. Ali Shah Geelani’s questions deserve to be answered by the Parliament of India if Prime Minister of India does not have strength to answer them. Whereas the leadership of the Parliament which has no strength to provide Fundamental Rights to the residents of J&K?
6. Syed Ali Shah Geelani needs to be answered by the Parliament of India and heavy political weights who roar inside the Parliament. Geelani says. “No nation has been enslaved through economic privileges and developmental lollypops.” In 1947 J&K was a nation, a state which acceded to the Union of India when its Ruler (Maharaja Hari Singh) signed Instrument of Accession like other 576 rulers. 575 states were merged into the Union of India. Why the State of J&K was not merged? Those who were abusing and accusing the national leadership for their failure to integrate J&K with the rest of the country have been in power for over 15 years. Their leadership dared not say even ‘Jai Hind’ the other day while addressing the Kashmiri audience in Srinagar.
Prof.Bhim Singh has proposed a National Integration meeting urging the Prime Minister to hold an urgent meeting of the National Integration Council on the issue of relationship of J&K with the rest of the country. Condemning/accusing the Kashmiri leaders shall not mean anything. People of J&K deserve all Fundamental Rights available in the Constitution of India. Locking/arresting/detaining the leadership in J&K shall mean nothing. Extend the Indian Constitution with all its amenities and Fundamental Rights to the State of J&K. Reorganize the State as it existed in 1846 and treat all citizens of India in J&K at par with the citizens of India in the rest of the country.
Prof.Bhim Singh called on Parliament to resolve all questions vis-à-vis J&K through words and not bullets. Extend all Fundamental Rights to J&K as has been done in respect of all other 576 states. Reorganize J&K so that people of Jammu province as well as Kashmir Valley enjoyed all the privileges and fundamental rights as citizens of India.
